WHAT ARE LEGAL CONSEQUENCES FOR OVERSTAYING?

In case of overstay a foreigner can be warned, fined and even banned from entering Ukraine the next time.

In particular, articles 203 and 203-1 of the Code on Administrative Offences provides for a range of fines from UAH 1700 to UAH 5100 in case of overstaying.

A ban to enter Ukraine can be imposed at the border by border guards and it can be as long as 3 years and in some cases can be even more than 10 years! In particular, clause 3 article 13 of the Law of Ukraine On Legal Status of Foreigners and Stateless Persons rules that in case of ignoring the ban a relevant person may get a 10-year ban on entering Ukraine that adds to the remaining ban.

This procedure is regulated by the Instruction on the Order on Making Decisions by the State Border Service of Ukraine on a Ban on Entering Ukraine by Foreigners and Stateless Persons, approved by the Order of the Administration of the State Border Service of Ukraine No. 946 dated December 05, 2011.

Note, a ban can be imposed when there is a fact of overstaying as well as where there is an unpaid fine imposed for overstaying.

So, if you have already overstayed, then you should consider an option of visiting an office of the State Migration Service of Ukraine to notify them about this situation and to receive a relevant fine that you will pay as soon as possible. Such preventive actions may help you avoid being banned at the border. Always keep with you a fine payment receipt to prove that you have paid already this fine.
